http://www.esvachamber.org/calendar/categories.html Complaints about Chinese business practices in Zambia stretch back years and often are pointed to as examples of problems with Chinese investors across Africa. In 2005, an explosion at a Chinese-owned factory in northern Zambia killed 51 Zambian workers. In 2010 two Chinese managers were accused of shooting coal miners during a labor dispute. Months later, the mine agreed to pay compensation to 13 injured workers, and attempted murder charges against the managers were dropped.
cheap air jordan shoes People in an open society do not demand infallibility for their institutions, but it is difficult for them to accept what they are prohibited from observing. - From the landmark Wyoming public access case, Sheridan Newspapers (1983), quoting a 1980 case from Richmond, Va.It s no surprise that a number of legislators are rushing to the University of Wyoming s defense in the wake of the school s defeat in court last week.UW s Board of Trustees has been putting on the full-court press at the Legislature, spreading half-truths and distortions in an effort to keep its search for a president secret. And, of course, UW has a large number of friends in the Legislature. Finally, the trust level among public officials in this state is high: If UW says something, it must be true.Problem is, the university recently went to district court fully expecting that its argument that only a closed search will yield a quality president would win the day. It didn t even come close.Indeed, Judge Jeffrey Donnell said that while a negative impact from an open process might be possible due to the chasing away of good candidates, it also is possible that it might not happen. Thus, UW s argument that a closed process will protect the public good is not provable.Besides, the judge said, there is a messy and overriding problem: UW is the state s only four-year public university, and its stakeholders have a right to be part of the selection process. He wrote: It is undoubtedly easier, and sometimes better, to govern in secrecy. However, those citizens who truly care are simply not comfortable with the idea of being informed of the results of an important decision after the decision is made. So now UW is trying an end run around the judge with the aid of sympathetic legislators. House Bill 223 will be heard at 8 a.m. Monday in the House Minerals Committee. The measure would make secret all records related to the hiring of presidents of higher education in the state. This, apparently, is how things work in Wyoming: If you don t like a judge s ruling, you rush to the Legislature and ask it to nullify the decision. So much for the idea of independent courts. Apparently it would be better if judges just figured out what lawmakers wanted and then ruled in that direction, since the politicians are going to make the final decision. Maybe legislators should just assume the role of the courts, since they think they know better anyway. And then there is the fact that the passage of HB 223 would take away a right that properly resides with the people of the state: to oversee the operations of their university, which is funded with their taxes. Surely it is better to trust the politicians and bureaucrats to make the decisions than to involve the public in them. Ha!There are at least four arguments against the passage of HB 223:1 - UW President Tom Buchanan. Mr. Buchanan has been one of the best leaders in UW s history or at least that is what the Board of Trustees has said in the wake of his decision to leave. The irony: Mr. Buchanan is the product of an open selection process. Indeed, had the public not caused a stir in the wake of recommendations from a search firm in 2005, the trustees would blithely have gone about choosing someone else.Might that person have done a better job? Perhaps. Perhaps not. But the point is that public involvement was essential to the process that put Mr. Buchanan into his position. We continue to wonder why the trustees do not want to acknowledge that.As a side note, that open process in 2005 produced, among its finalists, the president of North Dakota State University and the chancellor of the University of Tennessee-Knoxville. Apparently the trustees are choosing to ignore that as well, since they argue an open process will chase away current leaders of universities. Again, we don t get it.2 - Open processes produce quality results. Ask the trustees at Laramie County Community College whether they believe a closed process would have better served them in 2012 when they chose a replacement for Darrel Hammon. Their response: not only no, but heck no.Virtually every stakeholder group now believes that LCCC got the right person in President Joseph Schaffer. And this was a very open process: Finalists were announced, they met with instructors and they answered questions in public forums. True, the LCCC Board of Trustees held its interviews with the candidates behind closed doors we still object to that part of the process but there is no reason to think UW would not enjoy similar results by keeping its process open.Another example: When Cheyenne was hiring a police chief, it publicly announced the finalists. That gave the media and residents time to check them out before interviews began. By digging into their backgrounds, the WTE was able to uncover problems with some of the finalists. UW s closed process would not allow that to happen.3 - The slippery slope. Lawmakers who favor HB 223 should ask themselves where all this will end.If the hiring of UW s president should be done in secret, then why shouldn t the hiring of a school superintendent, or a city manager, or a fair board executive or the administrator of the local weed and pest board?True, the selection of a UW president is important to the state. But it is no more important than is the hiring of a superintendent to a school district. Do lawmakers really want to head in this direction?4 - Best practices. Even the Association of Governing Boards of Universities and Colleges of which UW is a member encourages open hiring as the best way to get the job done.Yes, it says acceptance of applications should be done in private. But it also says schools should release the names of the finalists and have them hold open meetings with stakeholders as part of the hiring process, similar to what LCCC did.The association believes this builds buy-in from the community and allows stakeholders to judge which finalists are the best fit for the school. After all, it is very possible that the best people on paper will not flourish at UW.There is no hard evidence none that a closed process produces better results. That is why Judge Donnell turned away UW s contention that an open process would hurt the school and the state. We urge lawmakers to take a breath, ignore the disinformation from UW s trustees and apply sound reasoning. HB 223 will not be good for the people of Wyoming or their university and it runs counter to the culture of openness that this state s courts have regularly and consistently nourished. This bill should be rejected. And if legislators cannot bring themselves to do it, then Gov. Matt Mead should veto it when it reaches his desk. o
